SMSPup Mobile Privacy Policy

This privacy policy should be read in conjunction with our Terms of Service.

Your Privacy

Reward Mobile Pty Limited. ACN 111 772 206 ("SMSPup Mobile") is committed to adopting the highest standards to safeguard our customers' personal information.

SMSPup Mobile, like other companies operating in Australia, is bound by the National Privacy Principles as set out in the Privacy Act 1988 (Cth) and the Privacy Amendment (Private Sector) Act 2000.

SMSPup Mobile’s policy on the collection, use and disclosure of personal information is set out below.

This policy explains what information that SMSPup Mobile collects about Members of the Site and how we use this information.

Collection of Personally Identifiable Information

SMSPup Mobile only collects personally identifiable information that is volunteered by Members during the registration process or in response to specific information requests presented directly to Members.

SMSPup Mobile only collects information that is necessary for us to perform our business and provide this service.

SMSPup Mobile only records personal information that you provide directly to us. Generally, we only collect personal information about you in the following situations:

• When you register with SMSPup Mobile;
• When you send us an email; and
• When you use our services.

We will ask you when we need you to provide further personal information for any reason. Generally, we will only collect further personal information that is related to the services that you ask us to provide to you.

How SMSPup Mobile May Use Your Personal Information

Specific identifiable information is collected from Members for a number of purposes connected with our business operations, which include:

• processing your orders or applications;
• carrying out credit checking and scoring (unless we have agreed otherwise);
• providing you with products and/or services requested;
• Processing of rewards and prizes
• Administering your account;
• dealing with requests, enquiries or complaints and other customer care related activities;
• carrying out market and product analysis and marketing our products and services generally;
• contacting you about our companies' products and services;
• registering your details and allocating or offering you rewards, discounts or other benefits and fulfilling any requests or requirements you may have in respect of our loyalty or reward programmes and other similar schemes; and
• carrying out any activity in connection with a legal, governmental or regulatory requirement on us or in connection with legal proceedings, crime or fraud prevention, detection or prosecution.

Telecommunications and privacy legislation impose strict obligations on the Provider to protect the confidentiality of your personal information and to respect your privacy. You are able to gain access to your personal information that we hold. You may contact us by calling 1300 123 787. Your personal information is collected in order to provide you with a telecommunications services.

Sharing of Personal Information and Reporting to Credit Agencies

We may also use your information for purposes that are related to providing you with a telecommunications service which would be reasonably expected to (such as keeping you informed about features of our telecommunications services or conducting analysis in order to provide better service to you).

We may disclose or receive personal information or documents about you to;

1. Credit card providers or credit reporting agencies for the purposes permitted under the Privacy Act;
2. Law enforcement agencies to assist in the prevention of criminal activities:
3. Our service and content providers, dealers and agents, or any company within the SMSPup Mobile group for purposes that are related to providing you with telecommunications service which would be reasonably expected.

Unless you consent, we will not disclose your personal information to third parties, other than those who have contracted us to keep the information confidential, or who are subject to obligations to protect your personal information.

We may use third parties to supply and deliver rewards and prizes. In this case it is necessary to share your personal information for fulfilment purposes. These third parties are prohibited from using your personal information for any other purposes.

We may host competitions and information request forms on behalf of our clients. These forms will clearly identify the identity and contact details of the organisation collecting the personal information, and the information you provide will be managed according to the privacy policy of that third party. In the event that you complete a web form hosted by us, we will only disclose the specific information provided by you to that third party.

With the exceptions listed above, we WILL NOT edit, modify or disclose your personally identifiable information to any third party without your permission unless we believe such action is necessary to:

• Conform to legal requirements or comply with a legal procedure;
• Protect and defend SMSPup Mobile’s rights and property;
• Enforce the SMSPup Mobile Terms Of Service (TOS); or
• Protect the interests of our subscribers or others.

We may access your account, including its contents, as stated above or to respond to service or technical issues.

Collection and Use of Non-Personally Identifiable Information

Member Profile

SMSPup Mobile collects and stores general information about our Members and their activity on our site and affiliated sites so that we can improve our offerings and tailor content on our site and affiliated sites to meet the interests of our Members.

The information we collect includes the non-personally identifiable information volunteered during the registration process or in response to specific information requests presented directly to Members. Wherever possible, we will use the information we hold to improve the relevance of surveys and if applicable, email promotions that we send to Members.

SMSPup Mobile may make general aggregate data (such as age groups, interest profiles, geographic regions and other non-identifying information) about our Members available to existing and potential advertisers, business partners and investors. This aggregate data never contains specific identifiable information about any individual user.

IP Address

The SMSPup Mobile servers automatically record your IP address, your browser type and operating system when you access our site. We may use this information to help diagnose problems with our server, administer our web site and compile aggregate user information for our advertisers. If we detect fraud or abuse of our system we may use the IP address of the offender to take action against them.

Cookies and Clear GIFs

SMSPup Mobile uses Cookies to personalise your experience and identify you when you are logged in to our site. We may also use cookies to estimate our audience size and measure traffic to, and usage of, our web site.

SMSPup Mobile may use technology known as "Clear GIFs" on our Site, in our email communications and on the web sites of our affiliates or partners. Clear GIFs do not store or contain any personally identifiable information but they allow us to better track the effectiveness of our promotions.

Security of Your Personal Information

Personally identifiable information collected by SMSPup Mobile is stored in accordance with our site security policy and we take reasonable steps to ensure that member information is secure from unauthorised access, modification or disclosure.

How to Access & Correct Your Personal Information

Personally identifiable information collected by SMSPup Mobile can be accessed and updated by the Member by using the facility provided on the Site (you may be required to log in first).

Linked Sites

The SMSPup Mobile Site, the survey invitations we send you, and if applicable, the email promotions we send you may provide links to our partner and advertiser web sites. If you link to any of these Third Party sites this policy will not apply to your use of those sites.

Frequency of email or SMS communications

All communications that result from your SMSPup Mobile membership will be sent directly from us, and will prominently feature the SMSPup Mobile logo and our contact details.

We will only send you up to five promotions per day which may include emails, survey invitations or SMS. In general you will receive promotions from us less frequently than this.

Opting out of email and SMS communications

As a condition of receiving the discount for membership you must provide a valid email address and agree to accept email and SMS promotions from us.

Participation is entirely optional and you may opt-out of email and SMS promotions, without cancelling your SMSPup Mobile membership, by updating your preferences using the facility provided on the site. By doing this, you will no longer receive the SMSPup Mobile members discount; however your mobile service will remain active.

A link to an opt-out facility is also provided at the bottom of every promotional email and survey invitation that we send you. By following this link you may terminate your membership. You can also reply to SMS promotions to opt-out.

In the event that you opt-out of receiving up to five promotions per day, it may take up to 72 hours for your opt-out request to take effect. You will still receive relevant information relating to your mobile service.

Changes to this policy

SMSPup Mobile reserves the right to update this policy from time to time, in part or in whole. Depending on the nature of the change we may, at our sole discretion, either announce the change on our web site or notify members by email. If you do not agree with this privacy policy in whole or in part, or if you no not agree with changes made to this policy, you must terminate your account.
